The Gacaca Courts are competent for the trial of the suspects who have been classified after the reconstruction of facts as guilty in categories 4,3 and 2 defined by the law.
The persons classified in the first category will be judged by the tribunals of first instance.

The Cell's Gacaca Court is competent for the trial in the first resort of persons whose criminal acts or acts of criminal participation classify in the forth category. It is also competent for appeals against sentences given in the absence of prisoners.

The Sector's Gacaca Court is competent for the trial in the first resort of persons whose criminal acts or acts of criminal participation classify in the third category. It is also competent for appeals against sentences given in the absence of prisoners.

The District's Gacaca Court is competent for the trial in the first resort of persons whose criminal acts or acts of criminal participation classify in the second category. It is also competent for appeals against sentences given by the Sector's courts of his resort and against sentences given in the absence of prisoners.

The Province's Gacaca Court is competent in the hearing of appeals against his resort's Districts' courts' sentences and against sentences given in the absence of prisoners.

The Gacaca Courts are fully competent for the trial of genocide cases in activities of their resort such as to give the identity of the parties or witnesses, to search suspects' houses, to put them in custody...
